Abandoned Vehicle By-Law
Article I - In General
Below is the complete text of the Town of Millbury General By-Law Chapter 9 Article I, pertaining to Junk and Junk Dealers. ARTICLE I. IN GENERAL |

Sec. 9-1.
Storage of unregistered motor vehicles -Limited to two. |
No more than two (2) unregistered motor vehicles, assembled or disassembled, shall be kept, stored or allowed to remain on a parcel of land except by a person duly licensed under General Laws, Chapter 140, section 57-69 inclusive, and except as provided in section 9-2 of this by-law.

Sec. 9-2.
Same -Prohibited in front or side yards; exceptions. |
No unregistered motor vehicles, assembled or disassembled, or any parts thereof shall be kept, stored or allowed to remain in or on any front or side yard as defined in article 5 of the Millbury Zoning By-Law, except by a person duly licensed under General Laws, Chapter 140, Section 58, and except as provided in section 9-3 of this by-law.

Sec. 9-3.
Same -Permit required; notice of hearing; conditions for issuance. |
a. The board of selectmen may issue a permit to keep, store or allow any vehicles or parts thereof as described in Section 9-1 of this by-law on a certain parcel of land after said board has held a public hearing therein, first causing at least fourteen (14) days' notice of the time, place and subject matter of such hearing to be given, at the expense of the applicant, by:
1. Publication in a newspaper of general circulation in the town, such publication to be once each week for two (2) successive weeks, the last publication to be at least seven (7) days before the public hearing; *Cross reference -Garbage, trash and refuse, Ch. 7.
2. Registered or certified mail at least fourteen (14) days before the public hearing to each of the persons appearing upon the assessor/ most recent valuation list as the owners of property abutting said parcel.
b. Said board shall not issue such a permit unless it finds that the presence of said vehicles or parts thereof on such parcel:
1. Will not nullify or substantially derogate from the intent or purpose of this by-law
2. Will not constitute a nuisance;
3. Will not adversely affect the neighborhood in which such parcel is situated.

Sec. 9-4.
Same -Permit specifications. |
Each permit shall:
a. Specify the maximum number of such vehicles that may be kept, stored or allowed to
remain in or on such parcel; however, not to exceed two (2) such vehicles on any parcel used solely for residential purposes;
b. Be limited to a reasonable period of time, not to exceed six (6) months;
c. Be a personal privilege of the applicant and not a grant attached to and running with the land.

Sec. 9-5.
Same -Exceptions. |
The provisions of this by-law shall not apply to vehicles which are:
a. Stored within an enclosed building;
b. Designed and used for farming or agricultural purposes;
c. A maximum of two (2)-unregistered vehicles may be stored in a front or side yard if
there is no physical access to the rear yard and provided that any vehicle stored is complete and intact.

Sec. 9-6.
Same- Penalty for violation of Sections 9-1 through 9-5. |
Any owner or lessee of the property violating provisions of this by-law shall be fined not more than fifty dollars ($50.00) for each offense. Each day that the willful violation continues shall constitute a separate offense.
